2. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited ("Non-Excludable Rights"). If any part of these terms would otherwise do so, it applies only to the extent permitted by law.

3. Products and product information

• Our products are cosmetic hair and skin care products for external use only. They are not therapeutic goods and are not intended to diagnose, treat, cure or prevent any disease or medical condition. Individual results vary.
• Please read the full ingredient list on the product page and packaging before use, and carry out a patch test 24 hours before first use, especially if you have sensitive skin or known allergies. Stop using a product and seek medical advice if irritation occurs. Keep products out of reach of children, and avoid contact with eyes.
• Product images are for illustration. Packaging, labels and colour may vary slightly from the images shown, for example when the manufacturer updates its packaging.
• We take care to make sure product descriptions, ingredients and prices are accurate. If we become aware of an error, we will correct it and, if it affects an order you have placed, contact you before proceeding.

4. Prices and payment

• All prices are in Australian dollars (AUD) and include GST where applicable. Delivery charges are shown separately at checkout.
• If you choose to view prices in another currency, the amount is converted for convenience and your bank or card provider may apply its own exchange rate or fees.
• Payment must be made in full at checkout using one of the payment methods offered. Payments are processed securely by Shopify and our payment providers.
• We may change prices at any time, but changes will not affect orders that have already been accepted.

5. Orders

When you place an order, you make an offer to buy the products. We will email you an order confirmation, but a contract is formed only when we accept your order by dispatching the products or confirming acceptance. We may decline or cancel an order (with a full refund of any amount paid) if:

• a product is out of stock or no longer available;
• there is an obvious pricing or description error;
• we reasonably suspect fraud or unauthorised use of a payment method; or
• the order appears to be for resale or wholesale purposes. Trade and wholesale customers should contact us directly.

6. Delivery

Delivery options, costs and estimated timeframes are set out in our Shipping Policy. Risk in the products passes to you when they are delivered to the address you provided. Ownership passes to you when we receive full payment. For international orders, you are responsible for any import duties, taxes and customs charges, and for making sure the products can lawfully be imported into your country.

7. Returns and refunds

Returns, refunds and cancellations are handled in accordance with our Return and Refund Policy and your Non-Excludable Rights.

8. Promotions, discount codes and gift cards

Promotions and discount codes are subject to the conditions stated with the offer, cannot be exchanged for cash, and generally cannot be combined unless stated otherwise. Gift cards sold on our store are valid for at least 3 years from the date of purchase, as required by Australian law, and cannot be redeemed for cash except where required by law.

9. Customer accounts

If you create an account, you are responsible for keeping your login details secure and for activity under your account. Please tell us promptly if you believe your account has been accessed without your permission.

10. Reviews and content you submit

If you submit a product review, photo, comment or other content, it must be honest, reflect your genuine experience, and must not be unlawful, misleading, offensive or infringe anyone else's rights. You grant us a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with our store and marketing. We may moderate content that breaches these terms, but we will not remove or suppress genuine reviews just because they are negative.

11. Intellectual property

The Sunny Isle name, logos and product packaging are trade marks of their respective owner and are used with authorisation. All other content on this store, including text, images and design, is owned by or licensed to us and may not be copied or used for commercial purposes without our written permission.

12. Acceptable use

You must not use our store for any unlawful or fraudulent purpose, attempt to interfere with its security or operation, use automated tools to scrape its content, or impersonate any other person.

13. Liability

Subject to your Non-Excludable Rights:

• we are not liable for loss caused by using a product other than in accordance with its label and directions, or by a cause beyond our reasonable control (such as carrier delays, natural events or network outages); and
• where the law allows us to limit our liability for a failure to comply with a consumer guarantee in relation to goods not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited to replacing the goods or supplying equivalent goods, or paying the cost of doing so.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud.

14. Third-party links

Our store may contain links to third-party websites (such as social media or delivery tracking). We are not responsible for the content or privacy practices of those websites.

15. Changes to these terms

We may update these terms from time to time. The version published on our store when you place an order applies to that order.

16. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia. This does not remove any right you may have as a consumer to bring a claim in the courts or tribunals of the state or territory where you live.
